The United States Department of Justice (DOJ) issued a Second Request to a leading United States company to obtain additional information about the competitive impact of the transaction. The client needed to collect, process, and review potentially relevant information, in order to produce all relevant, non-privileged information, and a privilege log, within 60 days.

Given the tight deadline, the client wanted to incorporate use of technology-assisted review (TAR) to further reduce the document population requiring eyes-on review, and had complete confidence in Epiq’s advanced analytics capabilities and team.

Epiq worked closely with the client and the DOJ to create a government-validated end-to-end process
An Epiq TAR consultant participated in calls with the government’s legal team to explain the recommended TAR process and, upon approval, trained our client and its outside counsel. The DOJ validated the process used to exclude the non-relevant portion of the population and accepted the results of the TAR process. For the actual review, the Epiq review team created two separate workflows: A workflow for potentially privileged data based on a privilege screen, and a workflow of documents that would be produced to the government to identify any key issues or “hot” documents that required attention by counsel.
