Kirkland & Ellis, Jackson Walker Dominate Debtor-Side Bankruptcy as Restructuring Market Heats Up

Commercial Chapter 11 bankruptcy filings are rebounding after below-average years in 2021 and 2022, with July seeing 71% more filings than the same month last year, according to a Wednesday report from Epiq Global.

Average monthly filings so far in 2023 are also trending up after two slower years, according to additional monthly data provided by Epiq Global. Although July’s total of 362 commercial Chapter 11 filings represented a month-over-month decline from June’s 582 filings, the July total also brings average monthly filings for 2023 to 447 commercial Chapter 11s.

By comparison, 2022 and 2021 saw respective averages of 318 and 310 filings per month, while average monthly commercial Chapter 11 filings between 2015 and 2020 ranged from 443 filings in 2015 to 594 in 2020, according to an article from Law.com.
